The processing of your data takes place exclusively for the purpose of initiating a contract or subsequently for the processing of the concluded contract, in particular for the fulfilment of the obligations agreed in the concluded contract. If you voluntarily register for our newsletter by ticking the corresponding box, your data will also be processed for the purpose of sending you our newsletter electronically and/or by post. If you also allow us to name you as a reference on our homepage and/or our catalogues and/or our social media channels, your data will also be processed for marketing purposes as a result of your consent in this regard.
The lawfulness of the data processing is therefore based, on the one hand, on Art 6 para 1 lit b DSGVO (contract initiation and fulfilment) and, on the other hand, on both your consent pursuant to Art 6 para 1 lit a DSGVO and our legitimate interests pursuant to Art 6 para 1 lit f DSGVO. A legitimate interest for data processing pursuant to Art 6 para 1 lit f DSGVO exists above all in the following cases:
– to inform you about our products and services as well as news in the form of direct advertising;
– in order to be able to assess the creditworthiness and default risk in the exchange of data with credit agencies;
– to evaluate your satisfaction with our products and services.
The data disclosed by you will be forwarded to service providers, in particular to payment processing and parcel service providers, to the extent absolutely necessary for the initiation, processing and fulfilment of a contract. To this extent, the data disclosed by you will also be forwarded to Compagnie française d’assurance pour le commerce extérieur SA Niederlassung Austria (FN 383367a), Marxergasse 4c, 1030 Vienna (for bad debt insurance) and to Kreditschutzverband von 1870, Wagenseilgasse 7, 1120 Vienna (for creditworthiness information). The data you disclose may also be forwarded to legal and tax advisors, accounting firms or debt collection agencies if they require the data for the performance of their tasks. Your data will only be forwarded to processors who offer sufficient guarantees for data protection-compliant processing and who only process your data on our instructions on the basis of a written contract. No data is transferred to a third country (outside the EU).
In principle, your data will not be kept for longer than is absolutely necessary for the respective processing purposes mentioned above. Your data will therefore be stored until the expiry of the retention periods under tax law (usually seven years from the end of the calendar year) or, if the processing is based on your consent, until receipt of your revocation or, if the processing is based on our legitimate interests, until receipt of your objection, unless longer storage is necessary to keep evidence in the event of legal disputes (up to 30 years according to ABGB). Of course, we are guided by the shortest possible period.
If the processing of your data is based on your consent, you have the right to revoke your consent at any time. The lawfulness of the processing of your data until revocation remains unaffected by your revocation. If your data is processed on the basis of our legitimate interests to carry out direct advertising pursuant to Art 6 (1) f DSGVO, you have the right to object to the processing of your data for the purpose of such advertising at any time pursuant to Art 21 (2); we will also inform you of this in each newsletter. The lawfulness of the processing of your data until the objection remains unaffected by your objection.
In addition, you generally have the rights to information, correction, deletion, restriction of processing and data portability. If you wish to exercise these rights, please contact us (see above for contact details). You also have the right to lodge a complaint with the Austrian Data Protection Authority, Barichgasse 40-42, 1030 Vienna. The provision of your data to us is neither required by law nor by contract (and is therefore voluntary), but is – insofar as you wish to conclude a contract with us – absolutely necessary and required for the initiation or conclusion of the contract and subsequently also for the performance of the contract. If you do not provide your data, the aforementioned purposes cannot be fulfilled, so that, for example, a contractual relationship with us and the processing of the contract by us would not be possible. Your data will not be used for automated decision-making.
